Attorney General Announces Mortgage Fraud Lawsuits
TRENTON, NJ - July 15, 2009 - (RealEstateRama) — Continuing the State’s effort to combat mortgage-related fraud, Attorney General Anne Milgram announced today the filing of two new lawsuits charging a total of 10 individual and corporate defendants with selling bogus loan modification services to distressed homeowners.
Defendants in the two unrelated cases are charged with collecting unlawful “up-front” fees for loan modification services that either never materialized or made homeowners’ situations worse. The defendants also are charged with misleading consumers through false advertising and deceptive solicitations, and engaging in debt adjustment activity without a license.
In one of the two lawsuits, the defendants also are accused of violating federal law governing credit repair activity, and with founding a non-profit “financial advocacy council” solely to legitimize their fraudulent enterprises. The state has identified 42 homeowners victimized by the latest schemes.
“The conduct charged in these two cases is outrageous. It epitomizes the kind of callous, greedy and opportunistic fraud we are committed to halting,” said Attorney General Milgram. “In both cases, the defendants took advantage of desperate people who looked to them for help. They gained the trust of their victims through deceptive advertising and misleading sales pitches, then collected thousands of dollars in unlawful fees and provided nothing in return but empty promises and added financial misery. We intend to hold these defendants accountable.”
“Loan modification services are supposed to serve as a lifeline to homeowners facing foreclosure, but instead the unscrupulous operators in these cases used these programs to cheat struggling families and make a profit,” said New Jersey Department of Banking and Insurance Commissioner Steven M. Goldman. “This type of activity is particularly reprehensible when it occurs in tough economic times when people are fighting to stay in their homes and are especially vulnerable.”
With the lawsuits announced today, the state has filed a total of 11 civil mortgage fraud complaints since June 2008 naming 102 individual and corporate defendants, affecting more than 950 victims and property worth more than $29.1 million. The state has also obtained indictments or guilty pleas in seven criminal mortgage fraud cases involving a total of 10 defendants who were charged with victimizing close to 60 individuals and banks in connection with loans worth nearly $11 million.
The conduct charged in the state’s civil and criminal cases has included fraud that victimized people seeking to obtain loans through a broker, or seeking to own investment properties. Victims have also included those hopeful of improving their living situations via “rent-to-own” opportunities, as well as financially-desperate homeowners in need of loan modification help.
Named as defendants in one of the State’s new lawsuits are Ejike N. Uzor, a licensed attorney who lists offices in Linden and Newark, and Stephen Pasch of Green Brook Township, Somerset County. Charged in the same lawsuit are corporate defendants New Day Financial Solutions, a Newark-based company owned and operated by Pasch, and three other Pasch companies: NDROA, Inc., which operates from Pasch’s home in Green Brook Township, American Credit Repair and Settlement, LLC, and Paramount Debt Settlement USA, LLC, both of which operate from the same address as Pasch’s New Day Financial at 701 McCarter Highway, Suite 303, Newark.
Also named as corporate defendants are two Uzor companies: Uzor Financial Solutions, LLC and Ejike N. Uzor and Associates. Both companies list the same corporate address on McCarter Highway in Newark as the multiple companies run by Pasch. The American Financial Advocacy Council, a registered non-profit which lists both Pasch and Uzor as officers, is also named as a defendant. The complaint charges that American Financial functions as nothing more than a tool to further the fraudulent activities of Pasch and Uzor.
The State’s other new lawsuit names as a defendant Best Interest Rate Mortgage Company (BIRMCO), located on Haddon Avenue in the Westmont section of Haddon Township, Camden County.
Although the approach used by BIRMCO to defraud customers was different - the company used direct mail solicitations while defendants in the New Day lawsuit used Web-based advertising, radio ads and telephone outreach — the outcome was the same: homeowners seeking loan modification help were induced, through misleading promotional materials and deceptive sales pitches, to pay BIRMCO thousands of dollars in advance fees and got either nothing in return, or ultimately saw their financial situations become worse.
Details of the State’s two complaints are as follows:
Milgram v. New Day Financial Solutions, etc: Filed in New Jersey Superior Court in Essex County, the State’s seven-count complaint charges individual defendants Pasch and Uzor — along with seven corporations operated by Pasch, Uzor or both — with violating New Jersey’s Consumer Fraud Act. The complaint also charges violation of state advertising regulations, the New Jersey Debt Adjustment and Credit Counseling Act and the federal Credit Repair Organizations Act.
The suit also charges that the American Financial Advocacy Council was essentially a ploy to encourage consumer confidence in the services of Pasch and Uzor and their companies, through bogus “independent” recommendations made by the “non-profit.”
According to the State’s complaint, Pasch’s New Day Financial operated from at least September 2008 through March 2009, charging customers thousands of dollars - payable in advance - for loan modification services, and offering a “100 percent money-back guarantee” if the company failed to deliver. New Day representatives urged customers to stop making mortgage payments while the company sought loan modification on their behalf. The complaint charges that, typically, New Day failed to obtain loan modification for its customers, and in many instances put them in worse financial standing by instructing them to stop paying their mortgages.
The experiences of four different New Day victims, including three from New Jersey, are described in the complaint. In one case, a Sayreville woman paid New Day $2,500 for loan modification help and later learned her lender had no record of any contact with New Day. The woman, who had coincidentally received a loan modification offer from her lender, asked New Day for a refund after learning the company had done nothing for her, but never received one.
In another case, a woman from Howell paid $4,200 for New Day’s services in September 2008. She was instructed to make her check payable to Pasch’s company, NDROA. In early 2009, the woman received a letter from her mortgage company indicating that no loan modification review could begin because required documentation had not been provided. The woman tried repeatedly to contact New Day, but was unable to reach a representative except for one time, when she was instructed to be patient. Ultimately, the woman worked directly with her lender to modify her loan, but New Day never refunded her $4,200.
According to the State’s lawsuit, New Day posted notice on its Web site in March 2009 that it would no longer be soliciting loan modification clients. It was around that time, the lawsuit asserts, that the other defendant corporations belonging to Pasch and Uzor - including the non-profit American Financial Advocacy Council — formed and began soliciting loan modification and other debt-adjustment-related business.
According to the complaint, Pasch’s American Credit Repair and Debt Settlement, and his company Paramount Debt Settlement USA, as well as Uzor and Associates, jointly began operating a Web site called www.creditrepair199.com . The Web site offers credit repair and debt adjustment services, and provides a phone number to call to obtain such services. The same Web site advises consumers that they will be charged an “application/enrollment fee” of $199 per individual and $319 per couple, plus a $79-a-month service fee. (It is illegal in New Jersey to charge for credit repair services not yet rendered.)
The lawsuit also charges that the Pasch/Uzor “non-profit” American Financial Advocacy Council — through its Web site at www.lordsavemyhome.com — has sought to instill consumer confidence in the defendants’ bogus, for-profit operations. The complaint quotes the Web site as saying American Financial works “with a select group of Christian-owned companies that are able to assist consumers who are experiencing financial hardships.” The same Web site provides links to the Web sites of Pasch’s companies American Credit Repair and Debt Settlement and Paramount Debt Settlement USA, as well as the Uzor companies Uzor Financial Solutions, LLC and Uzor and Associates. None of the companies are licensed debt adjusters.
Among other things, the State’s lawsuit against Pasch, Uzor and the other defendants seeks to dissolve the non-profit American Financial, and asks the court to order a halt to the defendants’ unlawful business practices. It also seeks restitution for consumers and the imposition of maximum civil penalties.
Milgram v. Best Interest Rate Mortgage Company (BIRMCO): Filed in Superior Court in Mercer County, the State’s four-count complaint charges BIRMCO with violating the Consumer Fraud Act, state advertising regulations and the New Jersey Debt Adjustment and Credit Counseling Act. According to the complaint, BIRMCO is a state-licensed mortgage lender, but has no state license to conduct debt adjustment activity.
Despite having no license, BIRMCO has solicited loan modification customers since at least November 2008, typically by sending distressed homeowners direct mail solicitations that appear to have been sent by a government agency. The mailings describe the targeted homeowner’s specific mortgage information, discuss the availability of various government programs to help financially-strapped mortgage holders, and include a telephone number to call for further information. The telephone number is actually for BIRMCO, although the company’s name appears nowhere on the original mailing.
Once a consumer calls the number, he or she is promised that BIRMCO can negotiate a loan modification resulting in a lower interest rate and lower monthly payments. Consumers who accept the offer are charged an up-front fee of several thousand dollars and must sign a contract, but they are promised a refund if BIRMCO fails to obtain a loan modification. They are also told to stop making mortgage payments and to avoid contacting their lenders, purportedly to strengthen their position in seeking loan modification.
In fact, the State’s lawsuit charges, BIRMCO often does little or no work toward obtaining loan modification for its clients. The suit contends that clients who hire BIRMCO and heed the company’s advice to stop making mortgage payments end up learning - typically through a call from their lenders - that they are not only delinquent on their mortgages, but that nothing has been done to modify their loans. Ultimately, the suit charges, customers end up working directly with their lenders and obtaining loan modifications that would have been available in the first place.
Nonetheless, BIRMCO typically forwards a letter to the consumer afterward claiming credit for negotiating a beneficial modification. Customers who seek a refund after negotiating their own loan modifications or realizing BIRMCO did nothing for them usually either get nothing, or only a partial refund, the suit charges.
The State’s complaint describes the experience of several BIRMCO victims, including a Belleville woman who paid the company $2,900 up front and ended up with a loan modification that actually increased her mortgage payment by $70 a month because she followed the company’s advice to stop making mortgage payments. BIRMCO ultimately returned only half of her up-front fee.
As with the New Day complaint, the State’s lawsuit against BIRMCO asks the court to order a halt to the defendants’ unlawful business practices, seeks restitution for consumers and the imposition of maximum civil penalties.
The Attorney General urged any member of the public who has been a victim of mortgage-related fraud to report it by calling the Division of Consumer Affairs. New Jersey residents can call the toll-free hotline at 1-800-242-5846. Consumers from out of state can call 973-504-6200. Those seeking to file a complaint can also visit the Division’s Web site at www.njconsumeraffairs.gov.
Milgram also reminded homeowners facing foreclosure that free help may be available to them through the state’s foreclosure mediation program. She urged distressed homeowners to explore what help is available through the program by calling the toll-free hotline number at 1-800-989-5277 or visiting the Web site at www.NJForeclosureMediation.org. Through the foreclosure mediation program, qualified homeowners who are in danger of losing their homes can receive help from housing counselors, attorneys and a neutral mediator to resolve loan delinquencies.

I am a victim of BIRMCO’s loan modification promise. There are other companies working together with BIRMCO because I called BBB to verify their “A-” rating as well as spoke to a lady whose number was provided to me by BIRMCO stating the women was employed by the consumer lending bank and that the lady could vouch for BIRMCO’s crediabilty. I have nearly 4 full pages of email correspondance from 3 people employed by BIRMCO verifying they advised me not to pay my mortgage payment and not to speak with my mortgage company. I finally gave in to the pressure of the collection agency with my mortgage company and set up payments to get my mortgage caught up. Sure enough, I received a letter from BIRMCO telling me BIRMCO had reached an agreement with my mortgage company. I promptly notified my mortgage company who verified BIRMCO had never made any contact with my mortgage company. I began to pursue BIRMCO relentlessly with phone calls all of which I was promised a return call within 24 hours but had not spoken with them for nearly 2 1/2 weeks. I will continue to seek any possible avenue available to sue this company and see that BIRMCO is held accountable for their actions. I also want to know how to begin action to get my money back.
I am also being taken by BIrmco. They told me not to talk to my mortgage company and not to make my mortgage payments. They told me they would get me a lower, fixed rate. I was behind on my property taxes and they said to go ahead and let my morgage company pay them as Birmco woul just put that amount onto my loan when they had it modified.
GUESS WHAT?? They flat out lied to me about everything. My mortgage company is going to work with me, but, I have to send them $1400.00 to do the modification. As far as I am concerned, these banks and these brokers are all crooks!
I started dealing with BIRMCO early this year. After tremendous stress and unfulfilled promises they did nothing for me. My mortgage payment went down 20 bucks, but has been extended. Every time an agreement was offered by my lender the BIRMCO staff would drop off the face of the earth. I started doing research and they have LOST their backing by the BBB and have an astronomical amount of complaints. I am in shock that fraud this BLATANT can occur.
Broker lists home for sale on an MLS online [a short sale”] for $415,000; offer submitted for full asking price; bank rejects offer wants offers only over $600,000. Is this legal? Is it ethical?? I am confused……
I recieved a modification from New Day Financial Solutions and I am currently saving $1,000 per month. I tried to perform the loan mod on my own with my lender for months before signing up just to get no where then my lender encouraged me not to work with New Day even though they weren’t cooperative with me. End result I am more than happy with New Day!
We have been scammed by BIRMCO, we also did a check with the BBB and they got a great review. They advised us to stop paying our mortgage. We worked directly with the lender. Our mortgage went up $1000 as a result. We were scammed. We too are looking into taking legal action.

Has anyone had received any feedback from the Consumer Affairs department regarding their claims. I filed a claim and received confirmation of a claim number but that has been all I have received. I am courious if it would strengthen our defense, if we file as a group with a lawyer. Any idea on how much a lawyer would charge for their services>

The name and number at the end of the article is just a reporter/writer. I had orginally asked to speak to him but was told he was only a writer and then was transferred to the Consumer affairs department. Maybe we should petition CNN or clark Howard to see if we get any better results. I agree these people need to be stopped. I know for a fact BIRMCO is still doing business. I had responded to a duplicate copy of a letter identical to the original letter from them and a “loan officer” called me back. The “loan officer” stated he was new to BIRMCO but felt certain he could answer any of my questions. I laughed and advised him to research a company BEFORE STARTING TO WORK there and “suggested” if he valued his career he should “move onto to newer pastures as quickly as possible”.

What I don’t understand is our case is all the same and the attorneyu general has brought a case against them that is identical to ours, why do we not have a law suit! We need a a class action consumer litigation lawyer who will take us on retainer. We have heard no word from any of the the state agencys, except to say they have received our paper work.

I have also been scammed by BIRMCO. Paid them upfront in January to negotiate my loan. Same story everyone else is telling. Received a letter stating my loan had been approved for loan modification from BIRMCO. Called my bank it had not been approved for loan modification. How can we get in on this lawsuit also?
Same story with BIRMCO!!! They are crap and I want to take legal action!!! Just wired 10,200.00 today to keep my lender from foreclosing!! They preyed on my wife and I when we were in a bind due to my wife having an accident and missing several weeks of work. They are absolute crap and as of today their number has been disconnected! Doesnt surprise me!
I’m another BIRMCO casualty. It’s going on 6 months now and still nothing. Ya’ll are right, that initial phone # they gave out is no longer working but they still are! I call their existing phone # and they give you the run around claiming everyone is tied up on the phones and they’ll call back in 24 to 48 hrs. Nothing yet! They need to stopped.

My home is in ForeCLOSURE as a direct result of dealing with BIRMCO. They ruined any chances of dealing with our mortgage company. I am on board if there is an attorney to represent us.

The attorney said that he would look over everything and let me know what my options are. All THIS COMPANY DOES IS LIE, I THINK IF THEY TOLD THE TRUTH HALF OF US WOULDN’T BE WHERE WE ARE TODAY, THEY SO NEED TO BE STOPPED.
Erica, your company said you modified my loan…..weeeee modified our loan, there is only record of 3 phone calls to bank of america, our payment is 1000.00 highr than when we started. Your company never even negotiated the bogust deal, in the end we had to take what we cold get to save our home. we are lucky to have family to rely on.
You can not modify loans. We are out $4000.00 and countless time and energy is going to be spent on a law suit.
Hey guys, Just wanted yal to know that i have continued trying to call BIRMCO. Yesterday they answered. Of course they put me through to some ladies voicemail that will never call me back! But I just wanted yal to know that the phones as of yesterday were back in working order!
We also dealt with BIRMCO, we are now in the foreclosure process and have been cheated out of 1250.00. Please let us know anything we can do. We have no money for am attourney, in fact soon, my family and I will be homeless!!
I have been dealing with BRIMCO for 1 year now They took my money. I Did get to talk to someone this morning and they are going to call back this afternoon yea right we will see, I will post if I get an answer from them today.
After i was a victim of Predatory Lending by New Century Mortgage Corp out of California when I recieved the letter in the mail from Best Interest Rate Mortgage I thought My troubles were going be over. My dealings with Best Interest Rate is pretty much the same as everyone else I lost 2045.00. I’ve saved every voice and email etc. I finally went to my local Congressman for help. Congressman Andrews his staff was wonderful. Please feel free to contact me anytime. I dealt with BRIMCO for about 18 months.
Ok update here is what they did my mortgage was handled finally but the second mortgage was not they kept saying they are working with my mortgage company and not to worry. I had to send information several times to them and as of now after they told me not to make payments because they are handling it. So now my second mortgage is charged off messing my credit up even more. Anyone have an idea what I can do about this. And what this means. Any good Attorneys that are going after this company?
We should bring a class action lawsuit against them at least we would get the money back that we paid to date helping out with our other bills that may have fallen behind during this mess.
I left a couple of comments earlier in the month but they do not appear for some reason. I have the same story to tell as all of you==just a different na,e. I was told that I just needed to have faith, God would take care of it. I am totally willing to work with all you guys if we can organize and file a class action case against these crooks. Like many of you, I don’t know where to turn. Why did the State of New Jersey file a class action suit rather than pick a couple of people that experienced the same rip off we did????? Also, like many of you, what extra money we had we sent to BIRMCO. There is no money to hire an attorney so are we just at their mercy. I too am in the same boat. I feel so foolish. I took it, hook, line, and sinker. All you have to do is tell me, and you will have another person on your class action suit. I have pretty well lost my life, so I can spend the rest of the time taking these &^$$#@^& down. I think they should be held responsable for what it would cost to keep our homes, or pay us back what we lost. I’m a big boy. I made a decision. I spent the money. I’ll take that loss. My wife and I also have been a victim of Birmco, they sent us a letter saying they had the personnell to do the modigications with our lender, after four months of phone calls we got notice our lender had received some paper work, but from there on all we ever get is, its in review.Now we find the lawsuit and all the people in the same boat we are in. I to would like to be included in the class action to take these people on!!!

I also was a victim from this firm New Day Financial, LLC on two(2) mortgages, primary home and investment property that i wasn’t able to rent due the recession it create financial stress to me and family.
In August of 2008 I went to New Day Financial, LLC for help in order to modify current high interest rates and make payments more affordable so I could try to keep my homes, I was told that I should stop paying my mortgages ASAP in order to begin process and after 3 months they would start negotiating with banks. So I did but a month ago I received a letter from my primary home mortgage lender stating that I will continue to pay same rates only thing that was changed was they add to the mortgage what I owed them plus city tax escrow, my payments are now higher than before and my credit is ruined because of it, I lost over 3k in cash to start process on both homes and obviously to make matters worse in addition to this I lost my family trust and divorce has started.
At this time I haven’t got any news from investment property lender stating any modifications to the mortgage but instead I was served for forecloser soon.
